Noble Fern provides online language learning programs featuring structured curriculum, instructor interaction, and digital learning materials. Services are delivered entirely online through our learning platform.

3. Enrollment and Access

To enroll in a program, you must:

• Be at least 16 years of age
• Provide accurate enrollment information
• Pay the applicable program fee

Upon enrollment confirmation and payment receipt, you will receive access credentials within two business days. Access remains valid for the duration specified in your program materials.

4. User Responsibilities

As a user of our services, you agree to:

• Maintain the confidentiality of your account credentials
• Use the platform only for personal educational purposes
• Not share, distribute, or resell course materials
• Not engage in any activity that disrupts platform functionality
• Communicate respectfully with instructors and support staff
• Comply with all applicable laws while using our services

5. Payment Terms

Program fees are stated in Canadian dollars and must be paid in full before accessing course materials. We accept major credit cards and electronic payment methods. All fees are non-refundable except as specified in our refund policy.

Refund Policy

You may request a full refund within 14 days of enrollment if you have not accessed more than 10% of the course materials. Refund requests must be submitted in writing to [email protected]. Approved refunds will be processed within 14 business days.

6. Intellectual Property

All content provided through our platform, including text, images, videos, exercises, and other materials, is owned by Noble Fern or licensed to us. You receive a limited, non-transferable license to access and use materials for personal educational purposes only.

You may not:

• Reproduce, distribute, or display course materials publicly
• Create derivative works from our content
• Remove copyright or proprietary notices
• Use materials for commercial purposes

7. User-Generated Content

When you submit assignments, participate in discussions, or otherwise create content within the platform, you grant Noble Fern a license to use that content for educational purposes, instructor feedback, and platform improvement.

8. Platform Availability

While we strive to maintain continuous platform availability, we do not guarantee uninterrupted access. We may perform maintenance, updates, or temporary suspensions as needed. We are not liable for any loss resulting from platform downtime.

9. Instructor Interaction

Instructor availability and response times vary by program. While instructors make reasonable efforts to provide timely feedback, we do not guarantee specific response timeframes. Instructor sessions are scheduled according to program specifications.

10. Disclaimers

Our language learning programs are provided on an "as is" basis. While we develop quality educational content, we make no guarantees regarding:

• Specific learning outcomes or fluency levels
• Employment opportunities resulting from language skills
• Success in language proficiency examinations
• Suitability for specific academic or professional requirements

Language learning results depend on individual effort, commitment, and aptitude. Our programs may support language acquisition, but results vary among students.

11. Limitation of Liability

To the fullest extent permitted by law, Noble Fern shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid for the specific program giving rise to the claim.

12. Termination

We reserve the right to terminate or suspend your access if you violate these terms. You may terminate your enrollment subject to our refund policy. Upon termination, your access to materials will cease, though you may retain materials explicitly designated as downloadable.

13. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.

14. Changes to Terms

We may modify these Terms of Use at any time. Material changes will be communicated to enrolled students via email. Continued use of our services after changes constitutes acceptance of modified terms.

15. Governing Law

These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
